These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Better Builder LLC (“BetterBuilder,” “we,” “us,” or “our”) governing your access to and use of: The BetterBuilder mobile and web application (the “App”), the platform at my.betterbuilder.app (the “Platform”), the website at betterbuilder.app (the “Website”), and all related services, features, content, and tools (collectively, the “Service”).
By creating an account, clicking “I Agree,” or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.
You must meet the following requirements to use BetterBuilder: You must be at least 16 years of age (or the minimum digital age of consent in your jurisdiction, if higher). You must have the legal capacity to enter into a binding contract under the laws of your jurisdiction. You must not be prohibited from using the Service under applicable laws. If you are between 13 and 16 years of age (in jurisdictions where 13 is the minimum), you must have verifiable parental or guardian consent.
By using the Service, you represent and warrant that you meet these eligibility requirements. If we learn that a user does not meet these requirements, we reserve the right to terminate that account.
To access the full features of BetterBuilder, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.
You are responsible for maintaining the confidentiality of your account credentials (username and password). You agree to notify us immediately at support@betterbuilder.app if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.
You are responsible for all activity that occurs under your account, whether or not you authorized it. You may not share your account with others or create accounts on behalf of others without their explicit consent.
Each person may maintain only one personal account. Creating multiple accounts to circumvent restrictions, exploit trials, or abuse the platform is prohibited and may result in permanent suspension.
BetterBuilder offers a free plan with limited access to the Service, including a limited number of coaching conversations per month and access to core features as described on our pricing page.
BetterBuilder Premium provides unlimited access to all features at the following pricing: Monthly Plan: $24.99 per month, billed monthly. Annual Plan: Discounted pricing as displayed at betterbuilder.app/pricing, billed annually. Pricing is subject to change with 30 days’ advance notice to existing subscribers.
New users may be eligible for a 7-day free trial of BetterBuilder Premium. Only one free trial is permitted per user and per household. At the end of the trial period, your account will automatically convert to the Free Plan unless you have entered payment information, in which case you will be charged the applicable subscription rate. We will remind you by email before your trial ends. You may cancel at any time before the trial ends to avoid being charged.
Subscription fees are billed in advance on a recurring basis (monthly or annual) through our payment processor, Stripe. By providing a payment method, you authorize us to charge that method for all applicable fees. All fees are in US Dollars unless otherwise stated. Applicable taxes may be added based on your jurisdiction.
You may cancel your subscription at any time through the App’s Account Settings or by contacting support@betterbuilder.app. Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until the period ends. We do not provide refunds for partial billing periods, except as required by applicable law (see Section 4.6 below).
If you are not satisfied with BetterBuilder, please contact us at support@betterbuilder.app within 14 days of your first charge and we will issue a full refund at our discretion. After 14 days, refunds are generally not provided, except: Where required by EU Consumer Rights Directive or applicable consumer protection laws in your jurisdiction; in cases of technical failure on our side that prevented you from using the Service; if we make a material change to the Service that you do not accept.
If a payment fails, we will attempt to retry the charge. If the payment is not resolved within 14 days, your account may be downgraded to the Free Plan. We will notify you by email before this occurs.
You agree to use BetterBuilder only for lawful personal development purposes in accordance with these Terms.
The following are strictly prohibited: Using the Service to harass, threaten, or harm any person. Attempting to gain unauthorized access to any part of the Service or another user’s account. Reverse engineering, decompiling, or attempting to extract the source code of the App. Using automated bots, scrapers, or scripts to access or interact with the Service. Uploading or transmitting malware, viruses, or any harmful code. Attempting to circumvent security measures, content filters, or access restrictions. Using the Service to violate any applicable law or regulation. Impersonating any person or entity, or falsely representing your affiliation. Creating accounts to circumvent bans, suspensions, or trial limitations. Using the Service in a way that could damage, disable, overburden, or impair our infrastructure. Sharing or publishing any other user’s personal information without their consent. Attempting to manipulate or game the AI coaching system to generate harmful outputs.
You agree not to submit content through the Service that: Is illegal, defamatory, obscene, or abusive. Infringes any third-party intellectual property rights. Contains personal information about other individuals without their consent. Is designed to deceive or defraud others. BetterBuilder reserves the right to review, remove, or refuse any content that violates these standards.
Coach Quinn is an AI-powered coaching tool, not a licensed therapist, counselor, psychologist, medical professional, or mental health provider. The Service does not provide medical advice, mental health treatment, psychotherapy, or crisis intervention.
BetterBuilder is a personal development and self-reflection tool. Coach Quinn uses evidence-based frameworks to help you identify patterns, build self-awareness, and take purposeful action. This is not a substitute for professional mental health care, medical advice, legal counsel, or financial advice.
If you are experiencing a mental health crisis, suicidal thoughts, thoughts of self-harm, or are in immediate danger, please do not rely on BetterBuilder. AI-generated content, including coaching responses, journal entries, and wisdom cards, may contain inaccuracies, errors, or content that is not appropriate for your specific situation. You should use your own judgment when reviewing AI-generated content before acting on it or sharing it.
BetterBuilder’s AI system may analyze your language patterns and behavioral evidence to personalize your coaching experience. This analysis uses our proprietary methodology and is not a clinical diagnosis. See our Privacy Policy Section 5 for full details.
We actively encourage you to seek qualified professional support for issues that require it. BetterBuilder is designed to complement, not replace, professional care. If Coach Quinn identifies signs that professional support may be beneficial, it may suggest this directly.
BetterBuilder and all associated intellectual property — including but not limited to the App, Platform, Website, software, code, design, branding, the Coach Quinn AI system, our proprietary coaching methodology, coaching prompts, and all content we create — are owned by or licensed to Better Builder LLC and are protected by copyright, trademark, patent, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes in accordance with these Terms.
You retain ownership of all content you create or submit through the Service (“User Content”), including your coaching conversations, evidence entries, journal entries, and wisdom cards. By submitting User Content to BetterBuilder, you grant us a limited, worldwide, royalty-free license to store, process, and display your content as necessary to provide the Service to you. We do not claim ownership of your content and will not use it for advertising or marketing without your explicit consent.
Content generated by Coach Quinn (including journal entries and wisdom card text) is produced at your direction and for your personal use. You may review, edit, approve, and share this content. Better Builder LLC does not claim intellectual property rights over personalized AI outputs generated on your behalf.
If you provide feedback, suggestions, or ideas about BetterBuilder, you grant us a royalty-free, perpetual license to use that feedback to improve our products and services without any obligation to you.
You may not reproduce, modify, distribute, sublicense, sell, or create derivative works from BetterBuilder’s intellectual property without our prior written consent.
Your privacy is governed by our Privacy Policy, available at betterbuilder.app/privacy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy. Special note: BetterBuilder uses AI to analyze your behavioral patterns and communication style to personalize your coaching experience. This process and your rights regarding it are fully described in Section 5 of our Privacy Policy.
BetterBuilder integrates with or relies on third-party services including OpenAI (AI processing), Stripe (payments), Supabase (database), and Vercel (hosting). Your use of the Service is also subject to the terms and privacy policies of these providers where applicable. We are not responsible for the availability, accuracy, or practices of third-party services. We choose our partners carefully, but we cannot guarantee their performance or compliance.
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. BetterBuilder does not warrant that: The Service will be uninterrupted, error-free, or secure. The results obtained from using the Service will be accurate or reliable. AI-generated coaching content will be suitable for your individual circumstances. Any defects in the Service will be corrected. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
To the maximum extent permitted by applicable law, Better Builder LLC and its officers, directors, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to BetterBuilder in the 12 months preceding the claim, or (b) $100 USD. These limitations apply to all causes of action in the aggregate, including contract, tort, strict liability, and any other legal theory. These limitations do not apply where prohibited by law.
You agree to defend, indemnify, and hold harmless Better Builder LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from: Your use of the Service. Your violation of these Terms. Your violation of any applicable law or regulation. Your User Content. Any claim that your User Content infringes a third party’s rights.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will endeavor to provide reasonable advance notice of material changes.
We may update these Terms from time to time. When we make material changes, we will: Update the “Effective Date” at the top of this document. Notify you via email at least 30 days before changes take effect for material changes. Display a prominent notice in the App. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription.
You may terminate your account at any time through the Account Settings menu or by contacting support@betterbuilder.app. Upon termination, your right to use the Service will cease immediately. Termination does not entitle you to a refund for any prepaid subscription fees, except as required by law.
We reserve the right to suspend or terminate your account at any time, with or without notice, if: You violate any provision of these Terms. Your conduct is harmful to other users, BetterBuilder, or third parties. Required by law or legal process. We decide to discontinue the Service. In cases of serious violations (such as illegal activity), we may terminate your account immediately without prior notice.
Upon termination, your license to use the Service ends. We will handle your personal data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimer, limitation of liability, and dispute resolution) shall survive.
These Terms are governed by the laws of the United States and the state in which Better Builder LLC is registered, without regard to conflict of law principles. For users in the European Union or United Kingdom, mandatory consumer protection laws of your country of residence may also apply, and nothing in these Terms limits your rights under those laws.
We encourage you to contact us first at support@betterbuilder.app if you have a dispute. We will make good-faith efforts to resolve disputes informally within 30 days.
If informal resolution fails, US users agree that any dispute arising from these Terms or the Service shall be resolved by binding individual arbitration administered by JAMS or AAA under their applicable commercial arbitration rules. The arbitration shall take place in the United States. This arbitration agreement does not apply to claims that may be brought in small claims court. CLASS ACTION WAIVER: You and BetterBuilder agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any class or representative action.
If you are a consumer in the EU or UK, you may also have the right to submit a dispute to an alternative dispute resolution (ADR) body. The European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Better Builder LLC regarding the Service and supersede all prior agreements.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
We are not liable for delays or failures to perform the Service due to circumstances beyond our reasonable control, including natural disasters, pandemics, acts of government, infrastructure failures, or third-party service outages.
These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version shall prevail.
